Third year of defects rectification in a new property

This property was bought brand new - just after completion, but not off the plan. However it doesn't matter much in NSW whether it's already built or off-the-plan. When dealing with builders/developers who don't want to comply with statutory or legal obligations, there is no easy effective...

Third year of defects rectification in a new property

Sorry for late response, crazy busy! :) Yes, EC amendments should happen at AGM. However you can still present at the meetings that EC runs (i.e. extraordinary meetings that are not AGMs) though you won't be able to vote on those meetings.

Hello Paul, I am glad to hear that my posts are helpful in some way. That was one of the main ideas to help others in similar situation. In regards to your questions. If your townhouse is part of strata title then I'd first report this problem to the executive committee or the strata manager...

    Neighbour abuse and defamation

Haven't watched TV in ages :) Regardless of American TV or suing trees, this situation is wrong. Scenarios with frequent defamatory statements from the same person should have some way of resolution that a lawful and bring responsibility on the perpetrator.

    Neighbour abuse and defamation

Thanks for sharing your personal experience! It's good to know and help guiding others in the right direction. I agree that it makes other people think differently and act differently towards the victim of the defamatory comments and messages regardless of the perpetrator's reasons to do that.

    Neighbour abuse and defamation

I see, thanks! It's good to have an advise like that from a specialist. I was not saying the lawsuit would be the only option. What I am intersted in is the variety of options available to stop that, because it is simply wrong. From equity perspective or simply put from ethics and common...

    Neighbour abuse and defamation

Thanks for your response, thatbum! By the serious consequences I mean the people who read those messages might see the victim as a bad person at the end and could either disregard completely or damage victims property or personality as a result of those statements. i.e. if someone would say...

Third year of defects rectification in a new property

That's right - very painful process. I haven't mentioned the company name yet until the process is all complete and I am sure their name could be shared righteously.

Third year of defects rectification in a new property

Thanks for kind words! I agree 100% about the industry set up. It also looks like the system helps businesses that don't care about quality or responsibility at all. Even when people know their rights it doesn't help much. because they have to spend so much time and effort to get what they are...

    Neighbour abuse and defamation

Well the strata manager says that it is unacceptable, but that's it so far. Will see how it can be taken from there.

    Neighbour abuse and defamation

No that happens not at the meetings, but in between. From what I see so far, the aggrieved party just raises issues that others don't like much or would like to not resolve it. Though the issues are all relevant and not wrong. i.e. the defamatory statement could be "unit x has done this" when...
